1. Who we are
This website, marksenmedia.com (the "Site"), is operated by Marksen Media ("Marksen Media", "we", "us"), a digital agency based at Järnvägsgatan 29A, 923 31 Storuman, Sweden. We are the data controller for the personal information described in this policy. You can reach us at william@marksenmedia.com.
This policy explains what personal information we collect through the Site and our landing pages, how we use it, who we share it with, and the choices and rights you have.
2. Information we collect
Information you give us
When you submit a contact, order, or intake form we collect the details you provide, which may include your name, email address, phone number, company name, current website, the plan or service you are interested in, your preferred contact channel (such as WhatsApp or SMS), your message, and your SMS consent choices.
Information collected automatically
When you visit the Site we and our service providers automatically collect
certain technical information, including your IP address, device and browser
type, the pages you view, the page you came from, and advertising click
identifiers (such as UTM campaign labels, Meta's fbclid, and
similar parameters). Some of this is collected through cookies and similar
technologies described below.
3. How we use your information
- To respond to your inquiry and provide the services you request
- To schedule, confirm, remind you about, and reschedule appointments
- To send you marketing communications where you have agreed to receive them
- To measure and improve the Site and our advertising campaigns
- To show you relevant ads, including retargeting ads, on third-party platforms
- To protect the Site against spam, bots, and abuse
- To comply with legal obligations and keep records of consent
4. Analytics and advertising
We use the following measurement and advertising technologies on the Site:
- Google Analytics — helps us understand how visitors use the Site (pages visited, session length, traffic sources). Google Analytics uses cookies and collects device and usage data. You can opt out with the Google Analytics opt-out browser add-on.
- Meta Pixel and Meta Conversions API — we use Meta's pixel (browser-based) and Conversions API (server-based) to measure the effectiveness of our advertising on Meta platforms (Facebook and Instagram) and to attribute form submissions to ad campaigns. This may involve sharing event data such as page views, form submissions, and hashed contact details with Meta.
- Meta retargeting — we use custom and lookalike audiences in our Meta ad campaigns, which means you may see our ads on Meta platforms after visiting the Site. You can control the ads you see in your Meta ad preferences.
- Cloudflare Turnstile — a privacy-friendly bot-protection check on our forms.
5. SMS, WhatsApp, and phone communications
If you provide your phone number, we may contact you by phone, SMS, or WhatsApp. We use Appointwise, an AI-powered sales and appointment-booking assistant, to handle some of this communication on our behalf — for example answering your inquiry, proposing appointment times, and sending booking confirmations and reminders via WhatsApp or SMS.
We distinguish two categories of text messages:
- Marketing messages — promotional texts about our services, offers, and follow-ups. We only send these if you have given express consent by ticking the marketing-consent checkbox on one of our forms. Consent is not a condition of purchase.
- Informational messages — non-marketing texts about your inquiry, appointment scheduling, confirmations, reminders, rescheduling, and customer support, sent if you have opted in to receive them.
For both categories: message frequency varies, and message and data rates may apply depending on your carrier and plan. You can opt out at any time by replying STOP to any message, and get assistance by replying HELP or emailing william@marksenmedia.com.
No mobile opt-in information or phone numbers collected for SMS purposes are shared with or sold to third parties or affiliates for their own marketing or promotional purposes. Text messaging opt-in data is used solely to deliver the communications described above.
6. Who we share information with
We do not sell your personal information. We share it only with the service providers that help us run our business, each of which processes it on our behalf:
- GoHighLevel — our CRM, where leads and their consent records are stored
- Appointwise — AI sales and appointment-booking communication via WhatsApp/SMS
- Google — analytics (Google Analytics) and advertising
- Meta — advertising measurement (Pixel, Conversions API) and retargeting
- Resend — transactional email delivery
- Vercel — website hosting
- Cloudflare — bot protection (Turnstile)
We may also disclose information if required by law or to protect our rights, and as part of a business transfer such as a merger or acquisition.
7. Legal bases (EEA/UK visitors)
Where the GDPR applies, we process your information on the following legal bases: your consent (marketing SMS, advertising cookies), performance of a contract or steps at your request before a contract (responding to inquiries, providing services, appointment scheduling), and our legitimate interests (site security, basic analytics, defending legal claims).
8. International transfers
Some of our service providers are based in, or process data in, the United States and other countries outside the EEA. Where personal data is transferred internationally, we rely on safeguards such as the EU–US Data Privacy Framework or Standard Contractual Clauses, as applicable to each provider.
9. Retention
We keep personal information for as long as needed for the purposes above: lead and customer records for the duration of our relationship and as needed afterwards for legal and accounting requirements, and consent records for as long as the consent remains relevant plus any legally required period. You can request deletion at any time (see below).
10. Your rights
Depending on where you live, you may have the right to access, correct, delete, or receive a copy of your personal information, to object to or restrict certain processing, and to withdraw consent at any time (which does not affect processing that happened before withdrawal). EEA/UK residents may also lodge a complaint with their supervisory authority — in Sweden, the Swedish Authority for Privacy Protection (IMY). Residents of certain U.S. states (such as California) may have similar rights under state privacy laws, including the right not to be discriminated against for exercising them.
To exercise any of these rights, email william@marksenmedia.com.
11. Security
We use appropriate technical and organizational measures to protect your information, including encrypted transport (HTTPS), access controls, and reputable infrastructure providers. No method of transmission or storage is completely secure, but we work to protect your data against unauthorized access, loss, and misuse.
12. Children
Our services are directed at businesses and adults. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, contact us and we will delete it.
13. Changes to this policy
We may update this policy from time to time. The "Last updated" date at the top shows when it was last revised. Material changes will be posted on this page.
